Luxury car rental agreement: insurance, excess, theft and fire explained

26 October 2026 · 9 min read · Team IsyLuxe

The daily rate is the most visible part of a luxury car rental, but it is not the part that matters most. What really makes the difference, for better or worse, is written in the rental agreement: what the insurance actually covers, the most you will pay if the car is damaged, what happens in case of theft or fire, and when the protection does not apply. This guide walks you through the clauses to read before you sign, in plain language, and explains how they work on cars booked with IsyLuxe.

What you actually sign when you rent a luxury car

When you book with IsyLuxe you receive a Booking Confirmation, which you can also sign electronically. It summarises your booking and contains the figures that matter: the car, the rental period, the total price, the confirmation deposit, the security deposit, the included mileage, the cost per extra kilometre, the pick-up requirements and the cancellation policy.

IsyLuxe is an intermediary: the car is provided by a supplier, the company that owns the vehicle. This is why you may also receive the supplier's own agreement at handover, with its conditions on insurance and use. The advice is simple: read both documents before the handover, not on the bonnet while someone is waiting to hand you the keys.

Insurance: what "included" really means

On cars booked with IsyLuxe, insurance is included in the price. But "insurance included" does not mean "no cost if something happens": it means the premium is already paid and your liability is limited, within the terms of the agreement. These are the covers you typically find in a luxury rental.

Third-party liability

It is mandatory and covers damage you cause to others: other cars, people, property. It does not cover damage to the car you are driving.

Damage to the vehicle (CDW)

Collision Damage Waiver (CDW), often called comprehensive or Kasko cover in Europe, applies to damage to the rental car itself, for example in an accident. It does not remove your liability: it limits it to the excess.

Theft and fire

Covers theft of the car and fire damage. Here too, if the event is covered, you pay at most the excess, not the value of the car.

The exact covers depend on the car and the supplier. Do not assume every car comes with the same protection: check the Booking Confirmation and the agreement to see which covers are included for the car you chose. If anything is unclear, ask before the handover.

The excess: the number to know before you sign

The excess (or deductible) is the part of the damage that you pay. It is the most important number in the agreement, because it is your maximum cost for damage covered by the insurance.

On cars available on IsyLuxe the excess equals the security deposit, which is shown on every car's page before you book. It is not negotiable and cannot be reduced. The upside is that you know your maximum exposure before you even book.

Minor or major damage: what you pay

  • Minor damage (a scratch, a mark on the bodywork): you pay the actual repair cost, up to the excess. Example: if the excess is €3,000 and the damage is assessed at €150, you are charged €150 and the rest of the deposit is released.
  • Major damage, total loss or theft: if the event is covered, you pay at most the excess. The insurance covers the rest.

For the full details on the hold, payment methods and release times, read our guide to the luxury car rental security deposit.

When the excess does not protect you: exclusions

This is the part of the agreement almost nobody reads, and the one that can cost the most. In some cases the excess limit does not apply and you can be held liable for the full cost of the damage. The main cases:

  • Driving under the influence of alcohol or drugs.
  • Unauthorised driver: someone not named in the agreement is behind the wheel. Even a friend or family member, even for a few kilometres.
  • Lost keys or car left unlocked: if the car is stolen because the keys were left inside, lost, or the car was not locked, the theft may not be covered.
  • Track use, racing or improper use: track days, drifting, competitions, off-road driving in a car not built for it.

The supplier's agreement may list other exclusions: read every one of them. They are only a few lines, but they decide whether you pay the excess or the full cost of the damage.

Theft or fire: what to do if it happens

  1. Report it immediately to the supplier and to IsyLuxe: support is available 24 hours a day, 7 days a week.
  2. File a police report with the local authorities (in Italy, the Carabinieri or Polizia) and keep a copy.
  3. Keep the keys: in case of theft, returning all the car keys proves there was no negligence.
  4. Document everything you can with photos, times and location.

The same rule applies to fire or an accident: safety first, then report it straight away, without waiting until you return the car.

Security deposit: a hold, not a charge

The security deposit is a pre-authorisation on your card, not a charge. The supplier places it at pick-up, usually on a credit card in the driver's name, and releases it immediately or within 48 hours of return. Cash is not accepted. Check your card limit before you travel: the hold reduces your available credit for the whole rental.

The other clauses to check

Included mileage and extra kilometres

Every rental includes a set number of kilometres and a cost for each extra kilometre, both shown in the Booking Confirmation. On a luxury car, extra kilometres add up: if you are planning a long trip, work out the route first and, if needed, ask for more kilometres when you book.

Fuel

Check the fuel level at handover and make sure it is recorded. If the car comes back with less fuel, the difference may be charged according to the agreement.

Fines, restricted zones and tolls

Fines incurred during the rental are the driver's responsibility, even when they arrive months later. The agreement specifies how they are handled and charged. In cities such as Florence and Milan the most common cause is entering a restricted traffic zone: read our guides to the Florence ZTL and Milan's Area C.

Drivers, age and licence

Only the people named in the agreement may drive. The minimum age and years of driving experience vary from car to car and are shown on every car's page. If you want a second driver, ask in advance: adding one after handover is not guaranteed. Driving in Italy on a US licence? See our guide to renting a luxury car in Italy as an American driver.

Crossing borders

If you plan to cross a border, for example into Switzerland or France, say so when you book and get confirmation that it is allowed. For mountain trips, tyres, chains and vignettes are covered in our guide to driving in the Alps in winter.

Cancellation and no-show

Under the standard IsyLuxe policy you can cancel with a full refund of the confirmation deposit up to 5 days before the rental starts. If you do not show up at pick-up, the full booking amount may be due. If your Booking Confirmation states different conditions for your booking, those apply.

Handover and return: your evidence

  • Film the car at handover: every side, the wheels, bumpers, interior, and the dashboard with mileage and fuel. One continuous video is worth more than a thousand scattered photos.
  • Check the handover report and make sure existing scratches and marks are noted before you sign.
  • Report any damage during the rental straight away.
  • Repeat the video at return, in the same order.

Checklist before you sign

  • Which covers are included for this car: third-party liability, damage, theft and fire?
  • What is the excess (that is, the deposit), and does my card limit cover it?
  • What are the exclusions?
  • How many kilometres are included, and what does an extra kilometre cost?
  • Who can drive? Is the second driver named?
  • Can I take the car abroad?
  • Until when can I cancel for free?

If you have an answer to all of these before handover, the rest of the trip is just driving. Choose your car from the IsyLuxe luxury car rental fleet: deposit, requirements and conditions are shown on every page before you book.

Luxury car rental agreement: frequently asked questions

Is insurance included in the rental?

Yes, on cars booked with IsyLuxe insurance is included in the price. The exact covers depend on the car and the supplier and are set out in the agreement.

What do I pay if the car is stolen?

If the theft is covered, you pay at most the excess, which equals the security deposit. Theft may not be covered if the keys were lost or the car was left unlocked.

Can I reduce the excess?

No. On cars available on IsyLuxe the excess equals the security deposit and is neither negotiable nor reducible.

What happens if a friend not named in the agreement drives?

An unauthorised driver is an exclusion: in case of damage the excess limit may not apply and you can be liable for the full cost.

Who pays fines that arrive after the rental?

The person who rented the car. The agreement specifies how fines are handled and charged.

Until when can I cancel?

Under the standard policy, up to 5 days before the rental starts with a full refund of the confirmation deposit, unless your Booking Confirmation states different conditions.
